Terms and Conditions

These Terms and Conditions govern your access to and use of the Hiveality website, software platform, hosted services, APIs, and related products.
1. Acceptance of these Terms
By accessing or using Hiveality, creating an account, joining a waitlist, purchasing a subscription, or using a website or feature we host, you agree to these Terms and Conditions and our Privacy Policy. If you are using Hiveality on behalf of a business or other entity, you represent that you have authority to bind that entity.
2. What Hiveality provides
Hiveality provides a software platform that may include website building and hosting, blogs, funnels, forms, quizzes, contact management, bookings, email and SMS marketing, ecommerce, memberships, courses, communities, analytics, AI-assisted generation, automation, APIs, webhooks, and integrations.
Some features are optional, in beta, plan-limited, integration-dependent, customer-configured, or not available in every workspace, plan, or jurisdiction.
3. Eligibility and account security
You must be at least 18 years old to create or administer a Hiveality account.
You must provide accurate information and keep it current.
You are responsible for safeguarding credentials, devices, API keys, and team access.
You are responsible for all activity under your account or workspace, including activity by invited team members.
You must promptly notify us of unauthorized access, suspected compromise, or billing issues.
4. Subscriptions, billing, and renewals
Paid plans are billed in advance on the billing cycle shown at checkout, such as monthly or yearly.
Unless otherwise stated, subscriptions renew automatically until canceled.
By subscribing, you authorize recurring charges to your selected payment method through our payment processor.
Taxes may be added where applicable and may be calculated automatically through Stripe or similar tools.
We may change prices, plans, or included features prospectively. If we do, we will provide notice where required by law or contract.
If a payment fails, we may retry the payment method, suspend features, or downgrade or terminate access.
5. Cancellations and refunds
You may cancel future renewals at any time, but cancellation does not automatically entitle you to a refund for the current billing period. Our separate Refund Policy explains that fees are generally non-refundable except where required by law or to correct a confirmed billing error.
6. Customer data, ownership, and licenses
You retain ownership of the content, data, branding, and materials you upload to Hiveality, subject to any third-party rights. You grant us a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, display, and otherwise use that material only as needed to provide, secure, improve, and support the services.
You are responsible for ensuring that you have all rights, consents, and permissions needed for the data, images, media, claims, testimonials, and other content you publish or process through Hiveality.
7. Your compliance responsibilities
If you use Hiveality to operate a business, market to contacts, or collect visitor or customer data, you are responsible for your own compliance obligations.
Publish accurate privacy, cookie, refund, accessibility, and terms notices for your own customer-facing properties as required.
Obtain valid consent for cookies, analytics, marketing, SMS, email, and similar processing where required by law.
Honor unsubscribe, opt-out, and preference requests, and comply with anti-spam and telemarketing laws.
Ensure health, wellness, medical, and professional claims on your sites are accurate, lawful, and appropriately substantiated.
Determine whether you may lawfully process regulated personal data, health data, minors' data, or other sensitive data on the platform.
8. No protected health information by default
Unless we expressly agree otherwise in writing after review, Hiveality is not offered by default as a system for storing or processing protected health information, insurance records, or similarly regulated medical data. You must not use the services for those purposes without our prior written approval.
Any HIPAA- or PHI-related use may require a separate Business Associate Agreement, specific configuration requirements, account approval, and additional one-time or recurring fees.
9. AI features
Hiveality includes AI-assisted tools for content generation, analysis, automation, and suggestions. To provide those features, we may send prompts, selected files, snippets of customer content, images, and other context to third-party model providers.
AI output may be incomplete, inaccurate, offensive, biased, or unsuitable for your use case.
You are solely responsible for reviewing and approving AI-generated output before publishing or relying on it.
You must not rely on AI output as medical, legal, tax, financial, or other professional advice.
We may impose limits, moderation, throttling, or approval steps on AI features at any time.
10. Acceptable use
You may not use Hiveality to do any of the following:
Violate any law, regulation, court order, or third-party right.
Upload or distribute malware, phishing content, spam, or abusive, deceptive, or fraudulent material.
Harvest credentials, scrape the platform in prohibited ways, bypass limits, probe for vulnerabilities, or interfere with service integrity.
Infringe intellectual property, privacy, publicity, or confidentiality rights.
Send unauthorized marketing, unlawful SMS, or messages to contacts without required consent.
Use Hiveality to provide emergency services, crisis response, or time-critical medical decision support.
Store or process regulated health data or other highly sensitive personal information without our written approval.
Misrepresent credentials, licenses, testimonials, clinical outcomes, refunds, or business results.
11. Third-party services and customer configurations
Hiveality integrates with third-party services such as Stripe, Supabase, Resend, Uploadcare, Mux, OpenAI, Anthropic, Twilio, Google, Meta, Zapier, and customer-configured webhooks and endpoints. Your use of those services may also be subject to their terms and privacy policies.
We are not responsible for third-party products, content, or sites, or for customer-configured integrations that send data outside Hiveality.
12. Beta, preview, and evolving features
We may label some features as beta, preview, experimental, or early access. Those features may change without notice, may be incomplete, may have reduced support, and may be discontinued at any time.
13. Availability, suspension, and changes
We may update, suspend, restrict, or discontinue any part of Hiveality at any time. We may suspend or limit access if we reasonably believe your use creates security, legal, reputational, operational, or financial risk, or if you breach these Terms.
14. Feedback
If you send us feedback, suggestions, ideas, or feature requests, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
15. Intellectual property
Hiveality and its software, designs, documentation, branding, logos, and other materials are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, we reserve all rights, title, and interest in and to the services.
16. Disclaimers
Hiveality is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and quiet enjoyment.
We do not guarantee uninterrupted, secure, or error-free service.
We do not guarantee any SEO ranking, conversion rate, revenue lift, deliverability outcome, or business result.
We do not guarantee the accuracy or suitability of AI-generated or customer-generated content.
We do not provide medical, legal, tax, or professional advice through the platform.
17. Limitation of liability
To the maximum extent permitted by law, Hiveality and its affiliates, officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or the cost of substitute services, even if we were advised of the possibility of those damages.
To the maximum extent permitted by law, our aggregate liability for claims arising out of or related to the services will not exceed the greater of the amount you paid us for the services in the 12 months before the claim arose or CAD $100.
18. Indemnification
You will defend, indemnify, and hold harmless Hiveality and its affiliates, officers, directors, employees, and suppliers from and against any claims, damages, liabilities, losses, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to your content, your use of the services, your customer-facing properties, your integrations, or your breach of these Terms or applicable law.
19. Termination
You may stop using Hiveality at any time. We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, create legal or security risk, or misuse the services. Upon termination, your right to use the services ends immediately, but sections that by their nature should survive will continue, including ownership, payment obligations, disclaimers, limitations of liability, indemnity, and dispute terms.
20. Governing law and venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. The courts located in Ontario, Canada will have exclusive jurisdiction over disputes arising out of or relating to these Terms, unless applicable law requires otherwise.
21. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date above and provide additional notice where appropriate. Your continued use of Hiveality after the updated Terms take effect means you accept the revised Terms.
