Service Description

Hiveality provides a comprehensive platform enabling health and wellness practitioners to create and manage professional websites with integrated features including:

• Website builder with customizable templates and design tools
• Contact and client relationship management (CRM)
• Private community forums and member areas
• E-commerce and product sales capabilities
• Booking and appointment scheduling
• Email marketing and campaign management
• AI-powered customer support (Agent Bee)
• SEO optimization and analytics

Accounts and Eligibility

• You must be at least 18 years old to use our services
• You must provide accurate information and maintain account security
• You are responsible for all activity under your account
• One person or entity may not maintain more than one free account
• We may suspend or terminate accounts for violations of these Terms or applicable law

Subscription Plans and Billing

Hiveality offers multiple subscription tiers (Starter, Builder, Pro) with different feature sets and pricing. By subscribing:

• You authorize recurring charges to your payment method
• Subscriptions auto-renew unless canceled before the renewal date
• Prices are subject to change with 30 days' notice
• Refunds are provided according to our refund policy
• You're responsible for applicable taxes
• Payment processing is handled securely by Stripe

Website Creation and Management

• You retain ownership of content you create and upload
• You're responsible for the accuracy and legality of your content
• Your website must comply with applicable laws and regulations
• You must not impersonate others or misrepresent credentials
• Professional claims must be truthful and substantiated
• We may review and remove content that violates these Terms

Acceptable Use

You agree not to:

• Engage in illegal, deceptive, or abusive activity
• Infringe intellectual property or privacy rights
• Submit malicious code, spam, or attempts to bypass security
• Use the platform to distribute harmful or inappropriate content
• Interfere with or disrupt the platform or servers
• Violate healthcare privacy regulations (HIPAA, PIPEDA, etc.)
• Use the service for unauthorized commercial purposes
• Scrape, copy, or duplicate platform features or content

Content and License

• Your Content: You grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute content you submit for the purpose of operating the platform
• Platform Content: Our platform features, design, code, and branding are protected by copyright and may not be copied or reused
• AI-Generated Content: Content generated by our AI tools (including Agent Bee) is provided to you for your use, but you're responsible for reviewing and approving before publication
• Stock Media: Licensed stock images and media are provided for use within your Hiveality website only
• Feedback: You grant us a license to use feedback to improve the services without obligation

Data and Privacy

Your use of Hiveality is also governed by our Privacy Policy. You are responsible for:

• Complying with privacy laws regarding patient/client data
• Obtaining necessary consents for data collection
• Maintaining appropriate security for sensitive information
• Not storing protected health information (PHI) unless using HIPAA-compliant features

Communications & Marketing

By providing contact information, you consent to receive transactional communications (e.g., account notifications, billing alerts, security updates). You can opt out of non-essential promotional communications, but transactional messages will continue as necessary for service delivery.

Third-Party Integrations

Our platform may integrate with third-party services (payment processors, email providers, analytics tools). Your use of these integrations is subject to their respective terms and privacy policies. We're not responsible for third-party services' performance or data practices.

Service Availability

While we strive for 99.9% uptime, we don't guarantee uninterrupted service availability. We may perform maintenance, updates, or modifications that temporarily affect access. We'll provide advance notice of planned maintenance when possible.

Disclaimer

The services are provided "as is" without warranties of any kind, express or implied. We do not guarantee:

• Uninterrupted or error-free service
• Specific results from using the platform
• That AI-generated content will be accurate or suitable
• That the service will meet all your requirements
• That security measures will prevent all unauthorized access

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or loss of data, profits, or business opportunities. Our aggregate liability related to the services is limited to the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the services, your violation of these Terms, or your violation of any rights of another party.

Termination

You may cancel your account at any time through your account settings. We may suspend or terminate your access for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended period of inactivity

Upon termination, your right to use the services ceases. We may retain some data as required by law or legitimate business purposes.

Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated via email or platform notification. Your continued use of the services after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes will be resolved in the courts of Ontario.
